Summary Of Hungarian Government Policy To  Refugees

The Government in Hungary does not like refugees. Public statements by members of the Hungarian Government show it particularly dislikes refugees who are not Christians.  If you are a refugee trying to enter Hungary you will not be welcomed. The government do want you in the country permanently. Neither do they want to let you in on a temporary or transit basis  so that you travel to other European countries.   See also the  Visegrad Group information  at the bottom of this link

Main Hungary Border Controls

You can enter Hungary freely if you have a European Union passport or a passport from another country recognised by the Hungarian Authorities which may or may not require a visa depending on the country you are from.

If you do not have the above documentation you cannot enter Hungary even if you are only going to travel through Hungary to another country.  You can apply for asylum in Hungary at a border post – scroll down for details.

Some Hungarian border posts are closed completely whilst others are only open to commercial traffic or local people with proof of identity. Occasionally these arrangements change without notice or warning as has happened several times at the main border crossing with Serbia tat Horgos-Roszke Coordinates: 46°09′12″N 19°58′13″E .

Note 1  If you are heading to the Hungarian border there is no guarantee that it will be open when you get there even if it is when you begin your journey.

You cannot cross the border illegally between Hungarian border posts as in most places on Hungary’s southern borders with Croatia and Serbia. there is a 4m high barbed wire fence to stop illegal entry into Hungary. Several thousand police and soldiers have been sent to Hungary’s borders to stop people entering Hungary illegally.

The police and soldiers have in September used water cannon and tear gas on people trying  to enter Hungary without permission.  The Hungarian Parliament since then has also authorised that they can shoot people with rubber bullets.

Note 2 If you are arrested and found guilty of entering Hungary you can be imprisoned and deported (or both) and because you will have a criminal record and under EU law you will not be able to get asylum in any other European Union country.

Note 3  If you entered Hungary from Serbia before being arrested there is the possibility that you could be detained or imprisoned indefinitely in Hungary as the Serbian Government has said it will not accept back anyone deported from Hungary.

Applying For Asylum In Hungary

If you are a refugee or migrant you do have  the right apply for asylum in Hungary but your application would be limited to Hungary. You  cannot at the Hungarian border apply asylum or residence in any other country in  Europe. You will not be allowed into Hungary so you can travel to the Austrian or Slovenian border to apply for asylum there.

When you apply for asylum you will be taken to a ”Registration Camp’ where you will have to stay whilst your application is considered.  These registration camps are secure – you cannot leave them – they are overcrowded uncomfortable and the  faculties. are poor. Some reports the food is poor and the camps are  not suitable  for children.

There are reports on social and in the international press that some applications for asylum are rejected within 30 minutes. Under Hungarian laws passed in September 2015  if you are refused asylum you can apply for a  ‘judicial review’  of your request for asylum.  This has to be made within three days of your request fir asylum being refused.  However provided the authorities have carried out the process correctly it is extremely unlikely the decision will be changed.

If you entered Hungary from Romania or Serbia the chances of your application being accepted  is very low. This is because the Hungarian Government see these countries as ‘safe’ places where you would not be in danger. Under Hungarian Law  as your  life would not be in danger you would not qualify for asylum.  You then would be deported back to the county you entered Hungary from.

Note 4  If you entered Hungary from Serbia before applying for asylum in Hungary there is the possibility that you could be detained or imprisoned indefinitely in Hungary as the Serbian Government has said it will not accept back anyone deported from Hungary.

Border Crossings Between Serbia and Hungary

Unless you are escorted by the Croatian Authorities you will find the all border crossings closed to you if you are a refugee, migrant. You will not be allowed to enter Hungary to travel Hungary’s borders with Austria Croatia Slovenia or Romania. You will not be able to apply for asylum in other European country at the Hungarian border. You can only apply for asylum in Hungary see ‘Applying For Asylum In Hungary” above.

Note 5  If you are in Serbia  you should consider heading for the Croatian border crossing at Bajakovo coordinates    45°2’51″N   19°6’6″E    and Tovarnik coordinates 45°10′N 19°9′E   Detail on Croatian borders can be found the Croatian page.

Border Crossings Between Romania and Hungary

Romania is not in the Schengen Zone  and this route is used by very people. Those  refugees and migrants that might use it will be refused entry. You will not be allowed to enter Hungary to travel Hungary’s borders with Austria Croatia or Slovenia.. You will not be able to apply for asylum in other European country at the Hungarian border. You can only apply for asylum in Hungary see ‘Applying For Asylum In Hungary” above.

If you are in Romania and cannot enter Hungary your options are limited. You could  turn round and travelling back south to Bulgaria which though and EU member it is not in the Schengen Zone.  Alternatively you could travel north to the Ukraine border (Ukraine is not an EU member)  but this route could be dangerous ee Ukraine Poland and Slovakia information on this page

Note 7  From late October the weather in Romania and neighbouring Bulgaria Romania can be come very cold with frost and snow. In the Ukraine the weather conditions can be more  severe.

Border Crossings Between Croatia and Hungary

The situation at these crossings can change at anytime of the day or night. Some times they are open – sometimes closed.   If you are a refugee or migrant who wants to travel through Hungary to Austria you should follow the advice and accept the help of the Croatian Authorities who at the moment the Hungarian authorities are co-operating with.

You should not turn up at the Hungarian border unless you are escorted by there by the Croatians.  You can still apply for asylum in Hungary but not any other European Union country at any Hungary order crossings – if it is open.  see ‘Applying for Asylum in Hungary’ above.

At present the Hungarian authorities are allowing some migrants and refugees to travel through Hungary if they are escorted to selected border crossings by the Croatian authorities.  This arrangement may not last and it could be stopped by Hungary at anytime.  If this happens and you being escorted to the border by the Croatians they will take you to a temporary camp or find an alternative route for you to continue your journey.

October 2nd Update:   Those refugees and migrants being escorted to the Hungarian border by the Croatian Authorities are at the moment being allowed to travel to the Austrian border.

October 11th Update: The future policy of the Hungarian Government remains unclear today. 98%  of the border with Croatia has been sealed but it has not been completed as they have run-out of materials for the fence.  These materials were coming from Germany but the Germany Government has stopped them being exported to Hungary. see also ‘Visegrad‘ on this page.

October 14th Update: From today  Migrants who enter Hungry illegally from Serbia are being arrested on criminal charges and denied the right to apply for asylum or international protection. They are detained for two to three days and then appear in court and given a prison sentence which under news laws introduced in September can be for as long as three years.

October 16th Update: The Hungarian Government confirmed last night that ithad completed the building of the barbed wire fence along it’s border with Croatia. This means that Hungary’s borders with Croatia and Serbia are defined by a Iron Curtain of fencing laden with razor sharp barbed wire..

October 16th Update (2): An advance contingent of 25 Czech troops  from two ‘engineer battalions was deployed to on Thursday to Kaposvar which is 69 km or 43 miles from the Croatian border.  It is understood that these troops are stationed at former Soviet airfield which was later used by NATO during the Kosovo war. The troops have equipment thought to be capable of repairing any damage or breaches of the fence.

October 16th Update (3)  Hungarian Foreign Minstar has announced that Hungary will ‘seal its borders with Croatia at midnight local time tonight.  He said there would only be a ‘trickle of refuges into Hungary across the Croatian border.  The installation of the final two miles (4k) of fence on the border was completes on the 15th.  Engineers from the Czech Army are based  in Hungary 69 miles  42km  with equipment to repair any damage to this fence if it is breached or broken by refugees

October 16th Update: (4) Hungary’s foreign minister Peter Szijjarto, said he that a meet8ing in Brussels of EU  leaders had not been prepared to send a EU  force to secure Greece’s borders and that Hungary was obliged to protect the external frontiers of the EU’s passport-free Schengen zone.

October 16th U0pdate (5)  Migrants who arrive at the Hungarian border will be taken to two transit camps where they will be able to apply for asylum in Hungary. They will not be able to travel through Hungary to any other country 

October 16th Update:  (6() Several as yet unconfirmed reports  from normally reliable media sources  indicate that Croatia and Slovenia will work together from midnight tonight to enable migrants to continue their journey into Austria and Germany. Details are expected  to be announced tonight.

October 16th Update 7 From midnight tonight (when Hungary seals its borders to refugees and migrants from Croatia)  Slovenia will allow refuges enroute for Austria and Germany provided Austria and Germany ace willing to accept them,

October 17th Update:   All Hungarian border crossings with Croatia are closed permanently to asylum seekers migrants and refugees. The only exceptions to this will be migrants who want to settle in Hungary permanently.-  see the ‘Applying for Asylum in Hungary’ section above
